§ 1 Information about the processing of personal data
In the following, we inform about the collection of personal data when using our website and offers. Personal data is all data that relates or can be related to you personally, such as name, address, email address, user behavior, etc.
The responsible person according to Art. 4 No. 7 of the EU General Data Protection Regulation (DSGVO) is RA Prof. Dr. Frank Tapella, Hammer Straße 20, 40219 Düsseldorf, Germany, tapella@tapella.eu, further information can be found in the imprint.
The website uses an encryption method (e.g. SSL) to protect the security of your data during transmissions. This prevents transmitted data from being read by third parties. You can recognize the encrypted connection by the fact that the address line of the browser starts with “https://” and the lock symbol in front of it.
If we use third parties for individual functions of our offer, we will inform you in detail about the respective processes below.
§ 2 Your rights
You have the following rights with respect to the personal data concerning you:
- Right of access,
- Right to rectification or erasure,
- right to restriction of processing,
- right to object to processing,
- right to data portability.
You also have the right to complain to a data protection supervisory authority about the processing of your personal data by us.
§ 3 General information requirements
If you contact us as an interested party, we process personal data only to the extent necessary for communication. When processing mandates given to us, we process personal data of our clients in order to communicate, advise, defend and fulfill orders, the legal basis for this is in each case Art. 6 I 1 lit. b) DSGVO. Insofar as interested parties or clients contact us by e-mail or let us know their e-mail address, we understand this as consent to communicate by e-mail, although e-mails are only encrypted during transmission and third parties can therefore take unauthorized note of their content. Interested parties and clients may object to the use of unencrypted e-mails at any time. In the course of our activities, we also process personal data of third parties such as opponents, in particular of the natural persons representing them, in order to fulfill the purpose of the assignment, the legal basis for which is Art. 6 I 1 lit. f) DSGVO, our legitimate interest being the proper processing of the mandate. Finally, personal data is also processed by our service providers, suppliers and business partners in order to fulfill contracts or carry out pre-contractual measures, Art. 6 I 1 lit. b) DSGVO. Recipients of this personal data may be, to the extent necessary and required, service providers for hosting services, IT, telecommunications, logistics and delivery, public authorities, in particular courts, parties to a legal dispute as well as their legal and attorney representatives, experts and sub-agents. The data is only stored for as long as the purpose for which it was collected or for legal reasons. Insofar as retention periods under commercial and tax law have to be met, the data relating to them will be stored for up to 10 years. If the data concerns facts to which the statute of limitations of 30 years applies, the storage period is just as long.

§ 5 Collection of personal data via contact form or e-mail
When you contact us by e-mail, the data you provide (e-mail address, name, telephone number, if applicable, and text message) will be stored by us in order to respond to your request. We understand this as consent to communicate by e-mail, although e-mails are only encrypted during transmission and therefore third parties can take unauthorized notice of their content. We delete any data collected in this context after storage is no longer necessary. If you communicate with us using the contact forms provided for this purpose, you have previously consented to the processing of your data pursuant to Art. 6 I 1 lit. a) DSGVO.
§ 6 Revocation and objection to data processing
If you have given us consent to process your data pursuant to Art. 6 I 1 lit. a) DSGVO, you may revoke this consent at any time with effect for the future. Such a revocation only affects the permissibility of processing your personal data after you have expressed it to us.

In case of your objection, we will review it and either stop or adjust the data processing or demonstrate to you our compelling legitimate grounds or the assertion, exercise or defense of legal claims on the basis of which we continue the processing.
If personal data is processed for the purpose of direct marketing, you as the data subject have the right to object at any time to processing of personal data concerning you for such marketing. After your objection, we will no longer process the personal data for these purposes.
§ 7 Information about cookies and the cookie manager
We use cookies on our website. Some of them are essential and technically necessary, so we do not require consent for their use. Others, on the other hand, help us to improve this website and your experience. Cookies are small text files that are stored on your hard drive associated with the browser you are using and through which information flows to the entity that sets the cookie. Cookies cannot execute programs or transfer viruses to your computer.
Cookies can be differentiated in terms of their scope and function into so-called transient and persistent cookies.
Transient cookies are automatically deleted when you close the browser. These include in particular the session cookies. These store a so-called session ID, with which various requests of your browser can be assigned to the common session. This allows your device to be recognized when you return to our website. The session cookies are deleted when you log out or close the browser.
Persistent cookies are automatically deleted after a specified period of time, which may differ depending on the cookie. You can delete the cookies in the security settings of your browser at any time.

§ 8 Integration of Google Analytics
This website uses Google Analytics, a web analytics service provided by Google, Inc (“Google”). Google Analytics uses cookies, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there. In the event that IP anonymization is activated on this website, however, your IP address will be truncated beforehand by Google within member states of the European Union or in other contracting states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage to the website operator.
This website uses Google Analytics with the extension “_anonymizeIp()”. This means that IP addresses are processed in abbreviated form, which means that personal references can be ruled out. Insofar as the data collected about you is related to a person, this is therefore immediately excluded and the personal data is thus immediately deleted.
The IP address transmitted by your browser as part of Google Analytics is not merged with other Google data.
You may refuse the use of cookies by selecting the appropriate settings on your browser or cookie manager, however please note that if you do this you may not be able to use the full functionality of this website. You can also prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) to Google and the processing of this data by Google by downloading and installing the browser plug-in available at the following link: http://tools.google.com/dlpage/gaoptout?hl=de.
We use Google Analytics to analyze and regularly improve the use of our website. The statistics obtained allow us to improve our offer and make it more interesting for you as a user. The legal basis for the use of Google Analytics is Art. 6 I 1 lit. f) DSGVO.
